Your Guide to Using Flybytes Safely

1. Introduction

Flybytes, operated by Figo Technologies B.V., Da Vincilaan 1, 1930 Zaventem, Belgium, VAT BE1030753177, Company No. 1030.753.177 (“Company”, “we”, “us”), provides digital telecommunications services as an eSIM reseller under the Flybytes brand.
These Terms of Service (“Terms”) govern your access to and use of the Flybytes website, mobile application (the “App”), and related services (together, the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy, which are integral to this agreement.
If you do not agree with these Terms, you must not use the Services.

2. Eligibility and Account Registration

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.
To purchase Services, you must create an account and provide accurate, complete, and up-to-date information, including:
Full name
Email address
You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You may register using third-party authentication providers such as Google or Apple; Flybytes does not store or have access to your third-party passwords.

3. Services Overview

Flybytes provides prepaid, data-only eSIM plans. Voice calls and SMS are not included unless explicitly stated.
eSIMs are delivered digitally via the App or email after successful payment. You are responsible for installation, activation, and correct use of your eSIM.
Connectivity is provided through third-party network operators. Availability, coverage, speed, and latency are not guaranteed and may vary by location and device.

4. Device Compatibility

Before purchasing, ensure your device:
Supports eSIM technology
Is not carrier-locked
Is compatible with the chosen plan and destination
By confirming compatibility, you acknowledge responsibility for this verification.

5. Pricing, Taxes, and Payment

Plan prices are displayed in the App and include applicable taxes such as VAT.
Payments must be completed in full via secure payment providers (Stripe, credit/debit cards, Apple Pay, Google Pay, etc.). Flybytes does not store full payment card details. The currency used is displayed at checkout.

6. Delivery, Activation, and Validity

eSIMs are delivered immediately after successful payment.
Plan validity starts as specified on the product page, either upon installation or first connection. Plans expire when the data allowance is used or the validity period ends, whichever comes first.
Each eSIM may only be active on one device at a time. Removing and reinstalling is allowed on the same device but not across multiple devices simultaneously.

7. Withdrawal and Refunds

7.1 Digital Content and Waiver
By purchasing, you consent to immediate delivery of digital content and acknowledge that your statutory right of withdrawal is waived once delivery begins, in line with Directive 2011/83/EU and Belgian law.
7.2 Non-Refundable Cases
No refunds are provided for eSIMs that have been delivered, installed, activated, or partially used, including cases of:
Device incompatibility or carrier restrictions
Installation errors
Limited coverage depending on location
Change of mind
7.3 Defective Digital Content
You retain rights under EU and Belgian consumer protection laws. Verified technical issues attributable to Flybytes or our network partners may be eligible for replacement or refund. Issues must be reported promptly with evidence.
7.4 Refund Processing
Approved refunds are issued to the original payment method. Processing time depends on financial institutions. Submit requests to support@flybytes.com with order number and device details.

8. User Obligations and Acceptable Use

You agree to use the Services lawfully and responsibly. You must not:
Resell, share, or distribute eSIMs
Use the Services for illegal, abusive, or fraudulent purposes
Interfere with network operations or introduce harmful code
Misuse may result in suspension or termination without refund, subject to law.

9. Monitoring and Enforcement

Flybytes may monitor usage to ensure compliance with these Terms, prevent fraud, and protect legitimate interests. Information may be disclosed as required by law.

10. Suspension and Termination

We may suspend or terminate access for suspected breaches, misuse, fraud, or unlawful activity. Termination does not affect rights accrued prior to termination.

11. Intellectual Property

All rights in the Services, including software, content, logos, and designs, belong to Flybytes or its licensors. You are granted a limited, non-transferable right to use the Services for personal purposes only.

12. Liability and Disclaimers

Liability that cannot be excluded under law remains.
Flybytes is not liable for indirect, incidental, or consequential damages, including data loss. Total liability is limited to the amount paid for the affected data plan. We are not responsible for interruptions caused by third-party networks, force majeure, or circumstances beyond our control.

13. Third-Party Services and Links

The Services may contain links to third-party websites. Flybytes is not responsible for their content, policies, or practices. Use of third-party services is at your own risk.

14. Personal Data Protection

Personal data is processed in accordance with applicable laws and our Privacy Policy.

15. Alternative Dispute Resolution

Consumers may seek out-of-court dispute resolution through recognized Belgian ADR bodies. Participation is required only when mandated by law.

16. Governing Law and Jurisdiction
These Terms are governed by Belgian law. The courts of Brussels have jurisdiction, without prejudice to mandatory consumer protection rules.

17. Changes to These Terms

Flybytes may update these Terms to reflect legal, regulatory, or operational changes. Significant changes will be communicated via the App or website. Continued use constitutes acceptance.
